These Terms and Conditions (“Terms”) govern your access to and use of the services provided by Poolsure, a brand of Aquasol Controllers Inc (“Poolsure,” “we,” “us,” or “our”), including our website, customer portal, mobile application, and SMS messaging programs (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

Use of the Service

The Service is intended for existing and prospective Poolsure customers to manage pool chemical delivery, equipment monitoring, service scheduling, and related account information. You agree to use the Service only for lawful purposes and in accordance with these Terms. You are responsible for maintaining the confidentiality of any account credentials and for all activity that occurs under your account.

SMS Messaging Program

By providing your mobile number and opting in through the Poolsure customer portal, you agree to receive transactional and operational text messages from Poolsure, including one-time verification codes, service alerts, delivery notifications, and related account communications. Message frequency varies. Message and data rates may apply. You may opt out at any time by replying STOP, and may request help by replying HELP. Participation in the SMS program is not a condition of purchasing any goods or services from Poolsure. Accounts and Eligibility

You must be at least 18 years old to create an account or use the Service. You represent that all information you provide is accurate and that you have the authority to act on behalf of any property or account associated with your use of the Service.

Intellectual Property

All content, trademarks, logos, and materials available through the Service are the property of Poolsure or its licensors and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Service without our prior written consent.

Service Availability

We strive to keep the Service available and accurate, but we do not guarantee uninterrupted access. Equipment readings, delivery predictions, and account data are provided for informational purposes and may be subject to delay, error, or unavailability due to maintenance, technical issues, or factors outside our control.

Limitation of Liability

To the fullest extent permitted by law, Poolsure and its affiliates will not be liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the Service. Our total liability for any claim arising from these Terms or the Service will not exceed the amount you paid to Poolsure, if any, for the service giving rise to the claim.

Termination

We may suspend or terminate your access to the Service at any time if we believe you have violated these Terms or for any other reason at our discretion. You may stop using the Service, and opt out of SMS messaging, at any time using the methods described above.

Changes to These Terms
We may update these Terms from time to time. We will post the revised Terms on this page and update the effective date above. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law principles. Any disputes arising from these Terms or the Service will be resolved in the state or federal courts located in Texas.
